Hon. James O. Browning, U.S. District Court, New Mexico, cited an article, "Class Actions, Civil Rights, and the National Injunction," written by Suzette Malveaux, professor and director of the Byron White Center, in his opinion issuing an injunction in New Mexico Health Connections v. United States Department of Health and Human Services. The opinion cites Malveaux to support the argument that prohibiting national injunctions will not stop forum shopping, and although national injunctions are an imperfect remedy, there are situations where justice cannot be served without it.
