Exclusions of Persons from University Property

I. Introduction

The University of Colorado Boulder (CU Boulder) is committed to fostering the safety, security, and well-being of its community. In pursuit of this commitment, exclusions—measures that restrict access to CU Boulder owned, leased, or controlled property (CU Boulder property)—may be employed. Exclusions are enacted when a person's behavior is deemed detrimental to the well-being or safety of the CU Boulder community or disrupts its educational and operational functions. 

II. Definitions

Administrative procedures: The chancellor’s or the chancellor’s designee’s adopted procedure to determine whether to issue an exclusion.   

Exclusion: The chancellor’s or chancellor’s designee’s order to exclude a person from all, or a portion of, CU Boulder property, either permanently or for a specified duration of time, as a result of:  

  1. An imminent risk to personal health and safety, CU Boulder property, or operations; 
  2. A violation of federal, state, or municipal laws, or University of Colorado (CU) laws or policies; or 
  3. A determination that the person’s behavior is detrimental to the well-being of CU Boulder or incompatible with the functions of CU Boulder as an educational institution.  

Imminent: Close in time, about to occur. 

Interim pre-investigation exclusion: A temporary exclusion utilized to protect the campus community while the exclusion investigation process is ongoing. 

Rapid Response Meeting (RRM): An interdepartmental group convened to review Office of Institutional Equity and Compliance (OIEC) alleged policy violations and assess risk.  

Ad-hoc Behavioral Intervention Team (BIT) Meeting: An interdepartmental group convened to review non-OIEC alleged policy violations and assess behavioral risk. 

III. Policy Statement

Pursuant to delegation from the CU Board of Regents and the CU President under Regent Law 14.B.6, the Exclusions of Persons from University Property Policy (Policy) governs the authority and procedures related to campus exclusions. 

The chancellor may exclude any person from CU Boulder property if their behavior is detrimental to the well-being or safety of the CU Boulder community or disrupts its educational and operational functions. The chancellor gives full authority to issue and enforce exclusions to the chief of police or their designee. Additionally, the chancellor delegates the authority to issue exclusions to the following administrators, provided they adhere to this Policy and any associated procedures and guidelines: 

  1. The Provost and Executive Vice Chancellor for Academic Affairs, or their designee; 
  2. The Vice Chancellor for Public Safety, or their designee; 
  3. The Vice Chancellor for the Office of Institutional Equity and Compliance (OIEC) and Title IX Coordinator, or their designee; 
  4. The Vice Chancellor for Student Life, or their designee; and 
  5. The Vice Chancellor for Human Resources, or their designee. 

Exclusions are serious measures that may be deemed necessary to support the safety and integrity of the CU Boulder community and its educational and operational functions. CU Boulder may utilize interim pre-investigation exclusions to foster the safety, security, and well-being of its community while the exclusion investigation process is ongoing. In all cases when an interim pre-investigation exclusion is being considered, the administrator or their designee should consult with the Department of Threat Assessment and CUPD or convene a Rapid Response Meeting (RRM) or Ad-hoc BIT Meeting. 

Following the investigation process, CU Boulder issues and enforces warnings and campus exclusions. The CU Boulder Police Department (CUPD) serves as the lead on enforcement of all campus exclusions, ensuring consistent implementation. The type of campus exclusion and corresponding actions are meant to address and correct behavior in a fair and consistent manner based on the specific concern. The process for determining the type of campus exclusion is intended to be flexible based on the unique circumstances and does not need to be followed in sequential order. In certain situations—particularly when the behavior is significantly disruptive or concerning— the designee issuing the campus exclusion may proceed directly to a more restrictive campus exclusion.  

The types of warnings and campus exclusions issued and enforced by CU Boulder include:  

Initial Warning and Letter of Expectations- A formal documentation of a warning with a clear outline of expectations moving forward, which may be issued on a case-by-case basis. 

Situational or Special Circumstance Exclusion- An exclusion from a specific location on CU Boulder property. The duration of a situational or special circumstance exclusion is determined on a case-by-case basis based on the specific concern. 

Temporary Campus-wide Exclusion- An exclusion issued to a person for all CU Boulder property. The duration of a temporary campus-wide exclusion is determined on a case-by-case basis based on the specific concern or issue. 

Permanent Exclusion- A permanent exclusion from all or part of CU Boulder property. 

The person being issued a campus exclusion may request in writing, within one month from the date on which notice is given of the exclusion, a hearing with the chancellor or the chancellor’s designee. The excluded person should refer to the administrator who issued the exclusion for information about requesting to appeal the decision. Current students issued a campus exclusion have additional rights outlined in the Student Code of Conduct. Employees who are issued a campus exclusion may work with Human Resources throughout the appeal and decision process.  

Any person who is under a permanent exclusion order issued by any administrator other than the vice chancellor for OIEC and Title IX coordinator may, once every five years, petition the vice chancellor for public safety for reconsideration of the exclusion order. Any person who is under a permanent exclusion order issued by the vice chancellor for OIEC and Title IX coordinator may, once every five years, petition the vice chancellor for OIEC and Title IX coordinator for reconsideration of the exclusion order. A written determination will be issued within 45 days of receiving the petition.
