Protection of Civil Rights

  1. Introduction 

In compliance with SB 25-276, the University of Colorado Boulder has adopted the following policy.  

 

  1. Policy Statement 

 

  1. CU Boulder does not to collect the following information, except as required by federal or state law (such as for employment verification, for example), as necessary to perform duties, or to verify a person’s eligibility for a government-funded program if verification is a necessary condition of government funding or participation: 

 

  1. Place of birth; 
  1. Immigration or citizenship status; or 
  1. Information from passports, permanent resident cards, alien registration cards, or employment authorization documents. 

 

  1. Aside from the above, CU Boulder may release an above-listed record if pursuant to: 

 

  1.  A subpoena, order, or warrant issued by a federal judge or federal magistrate; or 
  1. The consent of the student or the student’s parent or guardian through a valid release of information. 

 

  1. Roles and Responsibilities 

 

  1. Responsible Employees. CU Boulder designates the following responsible employees to be notified if information or access is requested for federal immigration enforcement: 

1.  Assistant Vice Provost & University Registrar; 

2.  Director, International Student and Scholar Services; 

3.  Chief of Police; and 

4.  Managing Associate University Counsel. 

  1. Procedures  

   A.   CU Boulder maintains the following procedures to provide: 

 

  1.  Personal identifying information (PII) of a current or former student;  

  2.  PII of a parent, guardian, or relative of a student; 

  3.  Access or consent to access non-public areas; and 

  4.  Information required by state or federal law in response to a subpoena, order, or warrant     

       issued by a federal judge or federal magistrate.

C.  Information Requested of Federal Immigration Enforcement. CU Boulder shall request and document    

      the following information from the federal immigration enforcement authority: 

 

1.  The first and last name, employer, and badge number of the person leading the federal  

      immigration enforcement; and  

2.  A copy of the subpoena, warrant, or order issued by a federal judge or federal magistrate to   

     allow access. 

 

D.  Communication of Information. CU Boulder shall promptly share information, as appropriate, about  

      a federal immigration authority’s request for information or access to the student who was the    

      subject of the request, or to the parent, guardian, or relative of the student.
