Policy on the Use of University Facilities

I. Users and Priority of Use

  1. The facilities of the University of Colorado, Boulder, are primarily for use by its students, faculty, and staff for activities and programs that are directly related to the basic educational, cultural, recreational, and on-campus organizational activities.
  2. The use of University facilities shall be provided on a non-discriminatory basis that ensures equal opportunity for all persons of the University of Colorado, Boulder, campus community.
  3. The term "Facilities" is defined as physical space.
  4. Academic Scheduling: the highest priority for the use of the University facilities is reserved for academic scheduling, i.e., classrooms, laboratories, and other facilities which are to be used for teaching and instructional programs for credit are scheduled by the Coordinator of Academic Scheduling (exceptions are Special Use Facilities - see below).
  5. Non-Academic Scheduling: all non-academic or out-of-the-classroom activities whether sponsored by academic schools, colleges, or departments shall be scheduled with the Non-Academic Scheduling Coordinator (exceptions are Special Use Facilities - see below). The use of University space for non-academic usage is subject to the following priorities and policies.
    1. After the credit classroom needs are met, the second priority of use of University facilities is assigned to schools, colleges, and departments for out-of-the classroom activities. Colleges, schools, and departments shall limit the sponsorship of non-academic activities to programs that fall under the purview of their official departmental mission. Users may schedule as far in advance as is necessary for their programs.
    2. The third priority of scheduling is reserved for those organizations (or individuals) that have University accounts with annually budgeted University funds, or those that receive funds from special allocations by the Cultural Events Board or other recognized programming bodies. Users may schedule as soon as Academic Scheduling has released rooms for ad hoc scheduling and up to one year in advance for weekend and interim-period scheduling.
    3. The fourth priority of scheduling is reserved for students, faculty, and staff members who do not have University accounts with annually budgeted University funds. Users may schedule as soon as Academic Scheduling has released rooms for ad hoc scheduling and up to one semester in advance for weekend and interim-period scheduling.
    4. The fifth priority of scheduling is reserved for non-profit agencies and educational institutions which conduct educational or research programs, when such agencies have an affiliation with the University, such as WICHE, NCAR, and similar organizations. Users may schedule their programs only for the current semester. Users may schedule East Campus space as soon as released by Academic Scheduling and other space only for the current semester.
    5. As a sixth priority of scheduling, the University may grant use of its facilities (as a state institution with a basic service function) to educational institutions, to city, state, or federal agencies, to political organizations which have appeared on the ballot in the State of Colorado, and to community, sectarian, or religious organizations whose activities are compatible with the broad educational mission of the University when such use does not conflict with University programs. In granting such use, consideration shall be given as to whether community facilities might more appropriately accommodate the proposed program. Such institutions, agencies, and organizations may be required to furnish insurance and/or bond to the satisfaction of the Committee on the Use of University Facilities (CUUF), see Section VII. Users may schedule their programs only for the current semester.

II. Special Use Facilities

There are certain special use facilities that have their own use priorities. These priorities take precedence over those listed in A - E above. The nature of these facilities requires that their principal users have highest priority for their use and limited control of use by others. In accordance with Sections III-E and Section VII-E of the CUUF Policy, Special Use Facility managers are responsible for alerting appropriate campus offices to events scheduled in their respective facilities that may impact the safety, welfare, or customary operations of the campus. Offices that may require such notice include but are not limited to: Chancellor, Vice Chancellor (s), the University of Colorado Police Department (UCPD), Parking and Transportation Services, Risk Management, Environmental Health and Safety, and Student Organizations Finance Office. Except as noted above, Special Use Facilities are governed by this policy.

III. General Conditions of Use

The facilities of the University of Colorado, Boulder, may be scheduled by members of the campus community (enrolled students, faculty or staff members, and sponsored organizations). When the facilities (including Special Use Facilities) of the University of Colorado at Boulder are scheduled, the individual and the sponsor of the activity agree to the following conditions:

  1. The sponsor of the activity will accept responsibility for sponsoring and supervising the program.
  2. The sponsor of the activity will accept responsibility for assuring that the scheduled facilities are used for the purposes for which they were scheduled.
  3. The sponsor of the activity will accept responsibility for operating costs (which includes rental fees, non-routine clean-up, police/security, parking/traffic) and for reimbursing the University for damage to University property or facilities that might occur in connection with the scheduled activity.

    The fiscal responsibility for any event falls with the sponsoring group or, if applicable, with the organization(s) who is funding the event. A security deposit to ensure fiscal responsibility may be required by the facility manager.
  4. The sponsor of the activity will ensure that all promotion and advertising of events involving the use of University facilities shall identify the individual or group that is the original sponsor of the event. All groups involved in funding of the event also need to be identified.
  5. The sponsor of the activity will take all reasonable steps to ensure that the use of scheduled facilities complies with local, state, and national laws, and University policies and regulations. This includes submitting all required applications for the proposed use as may be required by University policy.
  6. If a temporary structure is to be erected for purposes related to the program, the sponsor of the activity will ensure that the space is formally scheduled for the structure and is approved by the Department of Facilities Management in consultation with the Environmental Health and Safety Department.
    1. Regulations governing the erection of obstructions have been developed by the Department of Facilities Management. They ordinarily require two weeks notice prior to the erection of a structure.
    2. Structures erected in conjunction with a program shall be removed when the scheduled program ends and the landscape returned to its original condition.
    3. As provided in paragraph VIII. A. 2., there shall be no overnight camping in such structures.
    4. In order to provide for maximum use of University facilities by members of the University community, no temporary structure may be scheduled initially for longer than a one-week period of time. An extension for an additional one-week period may be requested from the Department of Facilities Management prior to the end of the initial period or any renewal period. This does not apply to academic projects such as Fine Arts Department displays.
    5. The member(s) of the University community responsible for the program shall ensure that the program ends as scheduled unless an extension is requested and approved prior to the original ending date.
  7. To maintain an educational environment and to ensure the safety of all members of the University community, the following conditions of use are expected in all classrooms, laboratories, and other facilities used for instruction. All members of the University community share in the responsibility for maintaining the educational areas in a good condition, ready for use by the students and faculty that follow.
    1. Consumption of food or beverages is discouraged in classrooms. Note that in some special-use facilities, food and drink are prohibited (e. g. , Norlin, the Business School).
    2. All trash shall be placed in a trash can or removed from the facility.
    3. Chalk/black/white boards shall be erased prior to departure.
    4. Desks and chairs shall be returned to their normal facility configuration.
  8. No temporary banners or signs except as provided through Section III. F. may be attached to the exterior of university general use facilities without prior approval from CUUF. Special Use Facilities may develop site specific policies. The following activities have been granted exemption from this provision:
    1. Shakespeare Festival
    2. United Way Campaign
    3. Holiday lights on Koenig Alumni Center
    4. UCPD safety campaign
    5. Registration information

    6. New student welcome/orientation/move-in
    7. Department of Theater and Dance
  9. The display of banners or signs inside buildings shall be at the discretion of the building proctor.

IV. Application for Use of University Facilities

  1. Applicants for Non-Academic Use of University Facilities shall submit a completed reservation request form to the Non-Academic Scheduling Coordinator (NASC) at least fourteen (14) days in advance of the planned event. For all outdoor events, applicants must also submit appropriate non-academic scheduling form(s) to the NASC, including all required signatures. The NASC may in his discretion waive this fourteen (14) day requirement for applicants that meet all other requirements for use of University facilities set forth in Section IV.C, the General Conditions of Use set forth in Section III, and the General Limitations of Use set forth in Section VIII of this policy.
  2. Applications will generally be reviewed and ruled on within ten (10) business days of receipt of a complete application, including all required information. On occasion, the application review process, including consultation with appropriate University officials, may require an additional five (5) business days. If additional time will be required for review of a particular application, the applicant will be notified of such circumstances within ten (10) business days of receipt of the application, including the reason that additional time will be required.
  3. The NASC or responsible administrative unit may deny an application for the use of university facilities if the applicant or person on whose behalf the application was made has on prior occasions made material misrepresentations regarding the nature or scope of an event or activity or violated the General Conditions of Use set forth in Section III above or the General Limitations of Use set forth in Section VIII below. The University may also deny, following consultation with appropriate University officials as necessary, an application for use of university facilities on any of the other following grounds:
    1. The reservations request (including any required attachments and submissions) has not been fully completed.
    2. A fully executed prior reservations request for the same time and place has been received, and approval has been or will be granted to a prior applicant authorizing uses or activities that do not reasonably permit multiple occupancy of a particular site.
    3. The use or activity intended by the applicant would conflict with previously planned University programs.
    4. The proposed event does not comply with the Policy’s General Conditions of Use set forth in Section III above or the General Limitations of Use set forth in Section VIII below.
    5. The proposed event presents an unreasonable danger to the health or safety of the applicant, members of the University community or the public. In particular, applications by individuals or organizations whose activities on the Boulder campus or elsewhere have established a history of causing material disruption with University activities, property damage, or personal injuries may be denied. Where the University believes that the particular health and safety concerns posed by a proposed event might be addressed, the NASC, at his discretion, may convene a meeting of selected University representatives to set requirements for the particular use of University facilities aimed at protecting the health and safety of the applicant, the University community and the public. Among other requirements, the approval of an application for use may be subject to the applicant’s securing of insurance or a bond, the payment of a security deposit, or the applicants agreement to pay security costs in connection with the event, as set forth in Section VII of this policy. If the applicant is unable or unwilling to meet these requirements, an application for use of University facilities may be denied.
    6. The proposed event presents an unreasonable risk of material disruption to other core academic, administrative or operational functions of the University. In determining whether a proposed event has the potential to materially disrupt the academic, administrative, or operational functions of the University, the NASC or other responsible administrative unit shall consider the history of the applicant’s prior event(s) at the University and elsewhere, including any history of the circumstances listed at Section VIII.E.1. a-e of this Policy. This section is not to be interpreted as a censorship device to prevent the unpopular speaker from presenting his/her views on this campus, but is solely designed to permit the University to prevent material disruption to the University’s core academic, administrative and operational functions.
    7. The use or activity intended by the applicant is prohibited by law, by the laws of the Regents of the University of Colorado, this Policy or other University rules or policies.
  4. Under the same criteria under which an application can be denied or approved with modification pursuant to Section IV.C of this Policy, a previously granted application can be revoked or modified. If a previously granted application is revoked or modified the applicant is entitled to the appeal rights described at Section IV.E of this Policy. If an application is denied, modified or revoked, a written explanation of the denial, modification or revocation will be provided to the applicant. This notice will advise the applicant of the appeal rights in Section IV.E below.
  5. Specific details of this policy, decisions made by the Non-Academic Scheduling Coordinator, or decisions made by individual administrative units may be appealed to the chairperson of Committee on the Use of University Facilities (“CUUF”), or the separately designated appeals officer for Special Use Facilities, for a recommendation to the Chancellor. The chair shall be responsible for bringing the relevant information to CUUF, which may (but not necessarily) include a presentation by the petitioner to CUUF. CUUF will make a recommendation to the Chancellor within fourteen (14) days of receipt of the appeal. The Chancellor shall notify the applicant of the outcome of the appeal in writing within fourteen (14) days of receiving the recommendation.

V. Open Meetings

Those who qualify to schedule the use of University facilities may set their own policies concerning opening or closing their scheduled activity to the public and news media, and such policies shall be stated at the time of scheduling. If such scheduled activities are closed to the public, they may be open or closed to the news media at the discretion of the sponsoring user. If such scheduled activities are open to the public, they are open to the news media. Unobtrusive use of still and motion picture cameras and recording devices is permitted during any open meeting. The presiding officer shall be the judge of whether such use is obtrusive and may, at his/her discretion, request persons to stop using their cameras or recording devices in a fashion which he/she deems to be obtrusive.

When an entertainer(s) and/or performing artist(s) or an agent thereof requests that a contract for performance preclude the use of still or motion picture cameras or recording devices because of third-party obligations, including union regulations or publishers' rights and/or interests, or performance or copyright restrictions, the University and/or the sponsoring user may so contract and must limit such uses during a performance. However, the University of Colorado, Boulder, Office of Public Relations may record and photograph entertainers, after contract negotiations, for internal, educational, and information use (i.e., archives) only, thus not violating the performer's right to third-party obligations.

VI. Protection of Free Speech

The University is committed to protecting the free speech rights of its students, faculty and staff. Assuming responsibility for the use of University facilities includes protecting the rights of speakers to be heard, the rights of the University community to hear speakers, and the reputation of the University as a center for free speech and scholarly inquiry. On certain occasions, the Committee on the Use of University Facilities or its chairperson may request the Executive Committee of the Boulder Faculty Assembly to appoint a chairperson to preside at the event and he/she will be empowered to take necessary steps to see that participants are treated with courtesy and to ensure the reasonable conduct of the event.

VII. Security of Speaker and Audience

The University may require that adequate security measures be taken to provide protection for persons seeking attendance, persons in attendance at an event, and for the University property involved. Where a proposed event presents a particular risk to the health and safety of the applicant, the University community or the public, or a danger to University property or facilities, CUUF may require insurance, a bond, a security deposit or security costs to be paid by the event sponsor adequate for the protection of those who may attend such an event and the University facilities involved. In determining whether such a requirement shall be imposed, CUUF shall consider (1) the number of anticipated attendees, (2) whether the proposed event involves activity that poses an inherent risk of personal injury or property damage (3) whether the sponsor intends to charge for admission to the event; and (4) any prior incidents of personal injury or property damage during similar events at the University or other institutions. CUUF shall inform applicants of such requirements in writing, including the reasons that the requirement has been imposed. The imposition of such requirements is subject to appeal under the process set forth in Section VI.E.

All persons entitled to use University facilities, either as individuals, or collectively as members of a group or organization, shall agree in advance, as a condition to the use of University facilities, that they shall abide by and adhere to Regents' Laws and University rules and regulations relating to the use of University facilities and student conduct policies. (Students' Rights and Responsibilities Regarding Standards of Conduct). The use of University facilities may be denied without such an agreement.

VIII. General Limitations on Use of University Facilities

All of the rules of the University and the laws of the Regents, and the State of Colorado shall be strictly observed and complied with.

  1. Commercial or Personal Use
    1. University facilities may not be used for commercial, personal, or private financial gain or for commercial advertising. Solicitors, sales persons, peddlers, and canvassers seeking student contact are not permitted to operate on the University campus or in any of its buildings or facilities without the personal and specific invitation of an individual student for a private meeting. Students may not arrange sales conferences for other students. Campus walkways, however, may be used to distribute free literature in such a way as to avoid interference with those entering or leaving buildings or with building occupants. The permission granted does not extend to distribution within any buildings, special use facilities, or any enclosed area. All Special Use Facilities have their own policies. From time to time the University will contract with an individual, group, or firm to provide services on the campus which result in a financial gain for the vendor or contractor providing such services. Such arrangements are excluded from this limitation provided they are made by a University department or organization having a University account and are approved by Buying and Contracting.
    2. University facilities shall not be used for overnight camping which is defined as follows: The use of University facilities for living accommodation purposes such as overnight sleeping or making preparations for overnight sleeping (including the laying down of bedding for the purpose of sleeping) or making any fire for cooking or using tents, motor vehicles, or other structures for sleeping or cooking. The activities described above constitute camping when it reasonably appears, in light of all the circumstances, that the participants in conducting these activities are, in fact, using the area as a living accommodation.
  2. Outdoor Events
    Outdoor events shall be held subject to all of the rules, practices, and administrative procedures now or thereafter in place with respect to such performances or events, and subject to the following requirements:
    1. Events in Folsom Stadium shall be on a reserved seat basis only.
    2. Evening/night events shall be concluded by no later than 10:30 p.m. Events scheduled at facilities without adequate lighting shall be concluded before dusk.
    3. At their expense, the sponsor and/or promoter of the event shall make adequate prior arrangements for, and see to it that, adequate sanitary facilities within and in the vicinity of the place where the performance is held are available before, during, and for a reasonable period of time following the conclusion of the event.
    4. At the expense of the promoter and/or sponsor, an adequate security force as approved by UCPD shall be on hand and in place prior to, during, and for a reasonable period of time after the conclusion of the event.
  3. Fund Raising
    University facilities can be used for fund raising under certain conditions:
    1. Fund raising is permitted when it is directly related to health. Such approval may made by the Chair of CUUF, the Non-Academic Scheduling Officer, or the Director of the Special-Use Facility.
    2. Fund raising is permitted when the proceeds are to directly benefit an official campus organization, program, or activity. All monies raised on campus or through the use of University facilities for the purpose of supporting a University program, activity, or organization shall be deposited into a University or University of Colorado Foundation account except for:
      1. Dues, membership fees, or collections from group members in the normal operations of an organization.
      2. Monies collected from incidental sales of merchandise provided such sales are not the purpose of the event. Such incidental sales would include informational materials directly related to the purpose of the group or program which are sold essentially at cost, t-shirts, CDs, and books.
      3. Voluntary collections for non-official departmental or organizational purposes.
      4. Where there exists a duly authorized contractual agreement to compensate the University for the use of the facility based on criteria other than a percentage of the "gate", e.g. flat fee or head count.
    3. Student organizations may contract for services through the Student Organizations Finance Office. This office shall arrange arrangements for proper contract, tickets, and security of monies.
    4. All funds raised on campus or through the use of University facilities shall be used for:
      1. On-campus organizational purposes. (An on-campus organization is one, which has a designated Boulder campus representative in charge of the group and has a current University account if the group is raising funds.)
      2. Cultural, educational, charitable, or recreational programs presented primarily for members of the University community. (A "charitable" program is a program that is lawfully applied, by a non-profit organization, for the benefit of an indefinite number of persons by bringing them under the influence of education or religion, by relieving them from disease or sufferings, or by otherwise promoting their general welfare. To be "presented primarily for members of the University community," a program must be advertised in University facilities and publications.)
    5. Third and fourth priority users may use University facilities including Special Use Facilities for fund raising purposes.
    6. Fifth and sixth priority users may not use University facilities for fund raising or profit purposes unless by contract. However, they may make charges reasonably calculated to recover their program costs. The Non-Academic Scheduling Coordinator shall have the authority to review prior submission of a budget and approve or disapprove the admission fee.
  4. Partisan Endorsement
    University facilities may not be used in any manner to involve the University as endorsing a partisan, political, sectarian, or religious position.
  5. Disruption of University Activities
    1. University facilities may not be used in ways that materially disrupt the University's own teaching, research, administrative, and service activities. Illustrative but not definitive of such kinds of disruption are the following:
      1. Violence
      2. Damage to property
      3. Persistent noise at a level clearly or repeatedly disruptive of classes, research, administrative business, study, etc.
      4. Extension of protests into academic, administrative, or student offices, classrooms, laboratories, study centers that are not considered part of or adjuncts to public corridors, except by permission or invitation.
    2. It is the University's intent to be a good neighbor to the Boulder residents in the areas adjacent to the campus, while at the same time allowing for the usual and customary campus events to take place.
      1. The facilities of the University of Colorado, Boulder, are primarily for use by its students, faculty, and staff for activities and programs that are directly related to the basic educational, cultural, recreational, and on-campus organizational activities.
      2. During the academic school year no use of amplified sound will be permitted before 9:00 A. M. on any day or after 10:00 P. M. Sunday through Thursday and after 10:30 P. M. Friday and Saturday. During the remainder of the calendar year no use of amplified music will be permitted before 9:00 A. M. or after 8:30 PM on any day. At no time shall the level of noise, amplified or unamplified, exceed 85 decibels on the A scale sustained for more than 15 seconds when measured at the perimeter of the campus surrounding the event. Amplified sound is not permitted on Norlin Quadrangle except as specified in VII. D. 6. d.
      3. It shall be the responsibility of the managers of Special Use Facilities, or the Non-Academic Scheduling Office for all other campus facilities, to insure that event organizers understand this policy, and that an appropriate mechanism for compliance is in place during the event to enable the University to respond to citizen complaints. At a minimum a member of the sponsoring organization shall be present throughout the event to serve as point of contact. University officials (e. g., representatives from the Chancellor, Vice Chancellor’s Offices, or UCPD) have the authority to require a reduction in the noise level to bring the event into compliance with this policy. Failure to comply within a reasonable period of time may result in a termination of the event, fines, and/or forfeiture of future use of University facilities.
      4. Specific exemptions are granted to varsity football games, University band practices/performance, Shakespeare Festival performances, New Student Convocation, and official events associated with graduation ceremonies and New Student Welcome.
      This section is not to be interpreted as a denial of the right to peaceful meetings, protests, or petitions for redress, nor is it a denial of the right to have such meetings, protests, or petitions taking place in the vicinity of those to whom they are directed.
    3. Proposed uses may be subject to additional reasonable time, place and manner restrictions based on University rules and policies, healthy and safety concerns and conflicts with the University’s broad educational mission and goals.
  6. F. Parking and Security
    1. Adequate parking to accommodate an event shall be arranged for within the constraints of University resources.
    2. It shall be the responsibility of event sponsors to coordinate with the University Police Department to insure adequate access and traffic control.
    3. Costs associated with the parking and traffic arrangements necessary to accommodate an  event are the responsibility of the event’s promoter and/or sponsor.
  7. G. Animals (including reptiles and amphibians) are not permitted in university buildings, with the exception of:
    1. Service animals
    2. Animals used in research, instruction, or official university business
    3. Fish aquariums
  8. Building proctors may grant temporary exceptions.

IX. Distribution of Literature, Sale of Newspapers and Magazines, Advertising, and Solicitation

  1. For the purpose of this policy, literature is defined as written matter, photos, and/or artwork that are not predominantly advertising or commercial in nature.
  2. For the purpose of this policy, solicitation is defined as a personal petition addressed to a particular individual to make a specific purchase of merchandise to be delivered to the buyer at a later time.
  3. Free Distribution of Literature (Not Posting)
    1. Free distribution of literature (solicitation or acceptance of contributions as literature is distributed is not "free" distribution) is permitted both inside buildings in public areas and outside buildings, provided that distribution does not disrupt or interfere with the normal activities of a particular place or building, and unrestricted ingress and egress to and from buildings and unencumbered use of sidewalks and street is maintained.
    2. The publisher, editor, author, or distributor of any literature distributed on campus shall be adequately identified on the materials distributed.
    3. Use of vending machines for free distribution of literature on campus is encouraged in approved areas.
  4. Sale of Literature
    1. Sale of literature which is essentially at cost is permitted outside buildings, provided that sale does not disrupt or interfere with the normal activities of a particular place or building, and unrestricted ingress and egress to and from buildings and unencumbered use of sidewalks and streets is maintained.
    2. Sale of literature is permitted within buildings, upon the approval of the principal academic or staff officer(s) or appropriate policy-making board for any such building. Special Use Facilities have their own policies.
    3. Use of vending machines for sale of literature on campus is encouraged in approved areas.
  5. Advertising
    1. No posting or distribution of commercial advertising is permitted for persons, groups, firms, etc. Commercial groups must receive University sponsorship, which includes a sharing of profits, to be eligible to post or distribute commercial advertising on campus.
    2. Groups eligible for use of University facilities may sell commercial advertising time on electronic communication systems that originate on campus as long as such sale of advertising is accounted for in the University Financial Reporting System.
  6. Licenses, Permits, Taxes, and Penalties
    1. In the State of Colorado, sales tax is imposed on all taxable retail sales. In general, a "sale" is at retail unless the buyer purchases the property for the purpose of reselling it to the ultimate consumer or incorporates it in a manufacturing process that produces a new product for retail sale. In the latter case, where the University is not collecting sales tax, the University is required to obtain and record the state exemption number of the organization.
    2. Therefore, every department on campus engaged in retail sales must collect sales tax on all taxable retail sales. This sales tax must be separate and distinct from the selling price. For more information contact the Auxiliary Accounting Division of the Accounting Office.
  7. Coupon Books
    Coupon books may be distributed on campus only if they conform to the following guidelines:
    1. The coupons must be in book form; they must be bound.
    2. The book must contain viable discounts.
    3. They must contain a variety of discounts from several businesses representing diverse commercial interests.
    4. The book must be sponsored and distributed by a recognized campus group.
    5. The sponsoring group's name must appear on the book.
    6. The coupon books must be distributed at no cost to the recipients.
    7. An amount of books comparable to the demand of students, staff, and faculty on campus during the term must be offered.
    8. Approval must be granted by the coordinator of the building where actual dispensing will take place.

X. Request for Exemptions from CUUF Policy

Requests for exemptions from specific provisions of the CUUF policy may be directed to the CUUF chairperson. The chairperson has the authority to grant or refuse exemption requests that are minor and limited in scope and impact. Such decisions may be appealed to CUUF. The chairperson may at any time, and for all requests that are significant in scope and impact, request review of an appeal by the entire CUUF committee. For all appeals heard by CUUF, the chairperson shall appoint a committee to research the appeal and make a presentation to CUUF. CUUF will then make a recommendation to the Chancellor. The Chancellor shall make the final decision.

XI. Organization and Functions of the Committee on the Use of University Facilities

  1. A standing Committee on the Use of University Facilities is established by and is responsible to the Chancellor of the Boulder Campus. The Committee on the Use of University Facilities shall have the following membership: a chairperson appointed by the Chancellor of the Boulder Campus; one of the UCSU Executives; chairperson of the UMC Board; two faculty members as determined by the Boulder Faculty Assembly; two staff members as determined by Boulder Staff Council; a representative of the Vice Chancellor for Student Affairs, UCPD, Student Organization Finance Office, and Risk Management. The Committee on the Use of University Facilities shall keep the Boulder Campus Faculty Assembly informed of its decisions and policies. The Non-Academic Scheduling Coordinator shall serve as permanent ex-officio. The Academic Scheduling Coordinator and a student member-at-large as selected by UCSU may also serve as ex-officio.

    The Committee on the Use of University Facilities shall:
    1. Review and recommend policies regarding the non-academic use of University facilities.
    2. Review and recommend all proposed exceptions to policies regarding the use of University facilities.
    3. Review group requests not fitting into previously established categories.
    4. Hear appeals from decisions regarding the non-academic use of University facilities. Appeals may be presented to the Committee on the Use of University Facilities either by a prospective user or by the Non-Academic Scheduling Coordinator with respect to arrangements for the use of facilities.
    5. The Chairperson of CUUF shall provide input into the selection of the Non-Academic Scheduling Coordinator by participating in the interviewing/selection process. The final selection will be the responsibility of the Director of the UMC.
    6. The Chairperson of CUUF shall provide input into the yearly performance evaluation of the Non-Academic Scheduling Coordinator. The performance evaluation will still be the responsibility of the Director of the UMC.
  2. Responsibility for administering the CUUF policy is in the office of the Non-Academic Scheduling Coordinator, Committee on the Use of University Facilities, and the responsible administrators of the Special Use Facilities.

XII. Chalking

The term “Chalking” refers to the time-honored practice at the University of Colorado at Boulder of using chalk on sidewalks for messages. These messages often concern student elections, student group meetings, Greek rush, political and social commentary, etc. The University supports freedom of expression, while striving to maintain order in a number of ways, including the promulgation of the following time, place and manner regulations:

  1. Chalking is prohibited inside buildings.
  2. The University restricts Chalking to exterior sidewalks and walkways that are exposed to natural elements. Chalking is prohibited on building exteriors including walls, doors, windows, facades, roofs, retaining walls, exterior vertical surfaces, benches, surfaces intended for seating, and horizontal surfaces under overhangs or roofs.
  3. Chalking must be done by using stick-chalk or some other substance that quickly fades away with the natural elements within a few days. Use of spray paint and spray chalk is not permitted.
  4. The University may erase any Chalked messages that do not comply with University policies and regulations.
  5. Any person or organization found to have violated the Chalking section of policy may lose Chalking privileges and/or be subjected to disciplinary action.
