Court Temporarily Blocks USCIS’s Unlawful Presence Memo

On May 3, 2019, a district court judge for the Middle District of North Carolina temporarily blocked USCIS's memo on accrual of unlawful presence for F, J, and M nonimmigrants. This memo was originally issued on May 10, 2018, and was then updated and took effect on August 9, 2018. This court decision could still be overturned if USCIS decides to appeal the decision.  Because the situation could change at any time, you should still be mindful about accruing unlawful presence in the US.
