Ms. Simpson's videotaped deposition was released pursuant to a request made under the Colorado Open Records Act. The University is legally required to comply with such requests.

Throughout the course of this litigation, the University has made every effort to protect the privacy of students and former students by asking the court to designate materials produced in discovery as confidential under a protective order. Although the protective order has been in place since May 2003, Ms. Simpson's attorneys had not designated the video depositions as confidential until ten o'clock this morning. Therefore, until this morning the University was required by law to release the tapes.

The University will comply with the requirements of the protective order and has notified members of the media of Ms. Simpson's request that the tapes be subject to the protective order and has asked members of the media to return copies of the tapes until the issue is resolved by the court.
