The U.S. House subcommittee on Health, Education, Labor and Pensions held hearings today on the Employment Non-Discrimination Act (ENDA) bill. ENDA is a proposed federal law that would prohibit discrimination against employees on the basis of sexual orientation or gender identity.Colorado Law’s Professor Helen Norton was one of the experts to discuss the pros and cons for the bill. Norton was invited by Chairman Andrews to offer her views as an expert in employment discrimination law on how this bill both tracks and departs from existing antidiscrimination law, and how it might be expected to work in practice. To view her testimony, click here.Currently, 13 states have policies prohibiting both sexual orientation and gender identity in discrimination in employment. Also, eight states have laws that prohibit discrimination based on sexual orientation only. Fifteen other states have laws that have been interpreted to protect transgender persons.
