Instructions and Information for J-1 Scholars

The following information is designed for international scholars who have been invited to this school for teaching or research as J-1 Exchange Visitors. We will issue you the Form DS-2019 (formerly known as the IAP-66), your certificate of eligibility for J-1 status at this school.

The five year time limit and 2 year bar to repeat participation

The total stay in the United States for Exchange Visitors in the "Professor or Research Scholar" category is limited to five years. Once an exchange visitor has completed a J program in either of these categories, regardless of if they used up all 5 years of the program, they will then be subject to a 2 year bar from repeat participation in these same categories.

The home-country physical-presence requirement

The purpose of the requirement is to have the home country benefit from the Exchange Visitor's experience in the United States. Exchange Visitors come to this country for a specific objective, such as a program of study or a research project. Not all Exchange Visitors are subject to the requirement, which is intended to prevent a participant who is subject from staying longer than necessary for the objective, and to ensure that he or she will spend at least two years in the home country before coming back to the United States for a long-term stay. For the terms of the requirement please see item 1 (e) on the back of Copy 1, the white copy, of Form DS-2019. If you have questions about the requirement, please raise them with the Consular Officer when you apply for your visa, or direct them to the International Office of this school.

If you are not yet in the United States

Visa stamp

To enter the United States as a J-1 scholar under this school's sponsorship, you must have a valid J-1 visa stamp in your passport. To apply for your visa, take this school's Form DS-2019 and your passport to a United States consulate. The Visa Officer may ask you to document funding that does not come directly from the University (with such items as a letter of award or support, a bank statement, proof of income, etc.). If your dependents will accompanying you, they will need J-2 visas, and you should take their passports with you to the consulate and be prepared to show proof of marriage to your spouse and parenthood of each child.

Two special notes:

  1. Canadians do not need passports or visa stamps to enter the United States, but they do have to show Form DS-2019 at the port of entry to obtain status as a J-1 scholar.
  2. Citizens of a number of countries other than Canada may enter the United States without visas, but only as tourists for a maximum stay of three months, not as Exchange Visitors or students. To change they have to leave the United States (and North America in most cases), apply for an appropriate visa at a United States consulate, and then fly back.

I-94 Departure Record card; Form DS-2019

When you arrive in the United States, an US Citizenship and Immigration Services (USCIS) officer will give you these two important documents, which you should keep in your passport. They are your only proof of your J-1 status, and you will need them for such purposes as extending your permission to stay in the United States and reentry to this country after temporary trips abroad during the period of validity of Form DS-2019. You should keep all copies of your Form DS-2019 permanently. It is also advisable, after your arrival, to photocopy the identification pages of your passport, your visa stamp, I-94 Departure Record card, and the Form DS-2019 and keep them separately from the originals, for use in applying for replacements if the originals should be lost or stolen.

If you are already in the United States as a J-1 Scholar

You may change your J-1 sponsorship to this school either by leaving the country and reentering or by transferring as long as you remain within the five year limit.

Leaving and reentering

If you go abroad and come back into the United States using this school's Form DS-2019, your reentry will permit your affiliation with this school. However, the "leaving and reentering" procedure may not work if you travel to Canada, Mexico, or the Caribbean islands for less than 30 days. This is because the Immigration inspector at the port of entry may hand back your Form DS-2019 intact and unmarked, and refuse to record your reentry. If that happens to you, you will have to proceed as though you had not gone abroad, and either leave North America and reenter the United States, or else carry out the "transferring programs" procedure.

Transferring programs without leaving the country by changing J-1 sponsorship

Inform your J-1 sponsor of your intent to transfer to another program. You may need to find out the new program sponsor's J program number Your current sponsor will then go into SEVIS, and do a 'transfer out' to your new program sponsor. That will release you to the new school's sponsorship. Then proceed either by notification or else by application.

Transferring by notification. You may use this procedure only if your I-94 Departure Record card shows "Duration of Status" or "D/S" instead of a specific expiration date. Bring your Form DS-2019 to this school's International Office. We will then process and complete your transfer into our program.

Extending Your Permission to Stay in the United States Your permission to stay in the United States ends on the date shown of your I-94 Departure Record card unless the card is marked "Duration of Status" or "D/S." In that case your permission to stay will expire 30 days after the date shown in item #3 of your Form DS-2019. If an extension is necessary, be sure to arrange it ahead of time by contacting your J-1 Responsible Officer at least two months before the expiration date shown on your Form DS-2019, in item #3.

Short Trips Out of the United States

To come back into the United States in J-1 status, you will need to have your form DS2019 signed by your J-1 Responsible Officer confirming both your affiliation with this school and the continuing availability of your financial support. Before endorsing your Copy 3, the Responsible Officer will first have to see proof of funding for the academic year of your trip abroad (the following year if you travel during the summer). If you will be leaving North America you will need a valid visa stamp to reenter this country. If your visa has expired, you will have to apply for a new one at a United States consulate abroad (see "Visa Stamp" in Part I). The visa applicant usually presents the Form DS-2019 and proof of financial support for the duration of the stay.
