Sanctions 2008-2009

The sanctions below appear in the order listed on your decision form. All other sanctions appear in alphabetical order following the decision form list. Should you have questions, please feel free to contact the Office of Judicial Affairs.

You may email completed sanctions to your conduct officer or to Antoinette.morales@colorado.edu. You may also bring them in person to the Office of Judicial Affairs.

Sanctions Found on the Decision Form

OJA Survey:
You are required go to http://www.studentvoice.com/CU/OJALearningOutcomesAssessment and fill out our survey. It should not take you more than approximately 15 minutes and will help us assess our process. At one point the survey will ask for your CU student ID number. This is only to partially verify completion of the survey, that number will not be linked to your answers. When you get to the completion page (or the page that says “Thank you for taking the survey”) please print it out and write the following on that sheet: Your name, email, student ID#, date and signature. This sheet should then be turned in to the Office of Judicial Affairs in Regent 206 to fully verify completion of the survey.

Warning or Written Reprimand:
This sanction serves as a disciplinary warning, which is official written notification that your behavior is in violation of the Student Conduct Code. This letter and our conference should serve to clarify expected behavior from you in the future. Future misconduct will be treated with more serious sanctions.

Probation:
You have been placed on university probation until the date noted on your decision form. Probation is a warning that your conduct as a university community member has been inappropriate and inconsistent with the standards set for members of the community. Any violation of the Student Conduct Code or the conditions of probation committed during the probationary period will subject the student to further action, with a likely result of suspension or expulsion.

This probation period is an opportunity to show by your actions that you can exhibit responsibility and be aware of your obligation as a member of the university community. You are expected to conduct yourself with integrity in a manner compatible with the university’s function as an educational institution. This sanction will keep this incident on file for six years after your graduation or withdrawal from the University of Colorado at Boulder, whichever is later. At the end of this period, your file will be automatically expunged unless another incident occurs during your time at the institution.

Suspension in Abeyance:
As a result of this incident you are being suspended from the University of Colorado, beginning and ending on the dates noted on your decision form. However, the suspension is being held in abeyance. Suspension in abeyance is a suspension from the university, but due to mitigating circumstances, the suspension will be deferred, allowing you to continue with daily university activities. If you are found, through the conduct process, to have violated any Standards of Conduct during the period of suspension in abeyance, you will be immediately suspended from the university for the duration of the abeyance period, and may face even more severe sanctions in addition.

Termination in Abeyance:
This letter serves as official written notification that your housing agreement has been canceled. However, the termination is being held in abeyance until the date found on your decision form. Termination in abeyance is a termination of the housing contract, but due to mitigating circumstances, the termination will be deferred, allowing you to remain in the residence halls. If you are found, through the conduct process, to have violated any Standards of Conduct during the period of termination in abeyance, your housing contract will be terminated and additional sanctions may be imposed.

Exclusion:
You are excluded from the area noted on your decision form until you are granted a review no earlier than the date found on your decision form. Violation of this exclusion could result in further judicial affairs action and in criminal charges, including arrest.

Parental Notification:
A letter will be sent to your parents, informing them that you have been involved in a drug or alcohol violation.

CU Restorative Justice Program:
You are required to complete the Restorative Justice program. Please contact Gina Bata at 303-492-0316 or via email at gina.bata@colorado.edu. You are required to participate in and complete the program as assigned by the date found on your decision form. Please submit verification that you have completed the program and a copy of your Restorative Justice contract.

Focus On Alcohol Concerns:
You are required to complete an alcohol assessment and attend the required alcohol class at Wardenburg Student Health Center by the date indicated on your decision form. Please go to Wardenburg in approximately one week, after we refer your information to them, to do the assessment and be assigned the appropriate class. You are responsible for the costs associated with this education.

Alcohol.EDU:
You are required to complete the online Alcohol.EDU for Sanctions program. Go to the website http://sanctions.alcoholedu.com/enter.aspx and use the Login ID: 8S126614S. When you have completed the program, you must print off verification to demonstrate that you have completed the program. This verification is due by the date indicated on your decision form.

2nd Offender Program:
You are required to complete the 2nd Offender Program offered by Boulder County Public Health by the date indicated on your decision form. Please call 303-441-1465 for registration information. The program consists of 12 weeks, 2 hours a week, of intensive examination of alcohol use vs. abuse, reasons for substance abuse, and decision-making strategies. Boulder Country Public Health charges approximately $30 per session for this program.

Level II Alcohol Class:
You must successfully complete a Level II alcohol class. Proof of completion must be on the letterhead of the program providing the class and must bear the original signature of the presenter. It is your responsibility to set up and complete the class. You are also responsible for any costs associated with the class. You must turn in proof of completion of this class by the date indicated on your decision form.

STARS Program:
You are required to complete the STARS program through Wardenburg Health Center. This is a semester long intensive program designed to challenge and support you around your relationship with alcohol. You are required to attend all meetings and be continually active in the program. You must attend your initial intake meeting by the date discussed with your conduct officer. Prior to this initial meeting, you are required to complete the 10 Dimensions of Health Worksheets. You are required to submit verification of completion of the program by the date found on your decision form.

Alcohol and Drug Evaluation:
You are required to undergo an alcohol/drug evaluation at Wardenburg Student Health Center 303-492-5654. Before the date on your decision form, you must submit to your conduct officer correspondence indicating that you have completed your evaluation. This correspondence must be on Wardenburg letterhead and must bear the original signature of the evaluator. It is your responsibility to set up and complete the evaluation. You are also responsible for any costs associated with the evaluation.

Compliance with Alcohol and Drug Evaluation:
You must comply with any and all recommendations issued as a result of your evaluation. Such compliance is due no later than the date found on your decision form.

E-TOKE:
You are required to complete the THC Online Knowledge Experience (E-TOKE) program. Go to http://www.colorado.edu/alcohol/students/marijuana.html and click on the link "e-TOKE" on the right. You will be given an identification number so you that log back in at any time, so please retain that number. Please print out verification that you completed the program. Verification of program completion is due by the date indicated on your decision form.

Marijuana Use Program at Rangeview Drug and Alcohol Counseling:
You are required to complete the 12-session marijuana use program through Rangeview Alcohol and Drug Counseling Center. The cost associated with participation in the program is $50. You may contact Rangeview Counseling Center at (303) 447-2038 to schedule an initial intake. Their office is located at 1790 30th St., Suite 305, Boulder, CO 80301.

Random Alcohol & Drug Testing:
You must sign up for random alcohol and drug testing. The Office of Judicial Affairs will refer your name to Boulder Alcohol Education Center (BAEC) at 303-444-6143 for this testing. If you are already undergoing random alcohol and drug testing, please inform us. You are responsible with any and all costs associated with this testing. You will be tested for the length of time and frequency noted on your decision form.

Community Restitution:
You must complete community service with a non-profit organization of your choice. The number of hours required can be found on your decision form You must submit to the Office of Judicial Affairs correspondence indicating that you have satisfactorily completed your service by the date indicated on our decision form. This correspondence must be on the organization's letterhead and must bear the original signature of the person supervising your service.

Volunteer Clearing House Presentation:
You are required to attend a one-hour workshop at the Volunteer Clearing House in the University Memorial Center, room 358. The purpose of this workshop is to introduce you to the principles of volunteerism while simultaneously looking at the importance of volunteerism in our society. As a part of this sanction, you will have the opportunity to choose from several local agencies to fulfill the community service requirement associated with the violation of the student conduct code. Monetary Restitution:
You must submit proof to the Office of Judicial Affairs by the date on your decision form that you have paid all restitution in relation to this incident.

Written Reflection
For ALL written reflections:

You should consider this paper to be no different than one you would submit to a professor for a class. This paper must be written in font size 12, double-spaced with standard margins. Your length requirement can be found on your decision form. This paper should be proofread and grammatically correct. This paper is due no later than the date found on your decision form. It is important for you to know that the Office of Judicial Affairs reserves the right to increase your current sanction and/or require you to re-submit the paper if there are mistakes, inappropriate language or messages. Being aware of this, it is in your best interest to turn the paper in early, in case any revisions are necessary. If you have any questions, please feel free to contact your conduct officer.

AApaper: Reflection Paper-Alcoholics Anonymous
You are required to attend an open Alcoholics Anonymous meeting and write a reflection paper on your reactions to the meeting.

Host: Reflection Paper – Social Host Liability
You are required to write a research paper on the social host and/or legal liability issues associated with alcohol. You must use a minimum of three references for your research, one of which must be an internet site.

  • What are the legal liabilities of a host?
  • What is the effect of alcohol on an individual’s body?
  • What is the effect of alcohol on the living-learning community?
  • What are the various limits of alcohol within the state of Colorado? Particularly, for a minor in Colorado, at what levels can the state take action against underage individuals walking or driving with alcohol in their system?

You are required to write a research paper about the effects of alcohol. You may use any sources necessary but must include a detailed bibliography of your sources. In addition, please respond to the following questions:

Bound: Boundaries
You must read the book, Boundaries – Where You End and I Begin by Anne Katherine, MA. You will then need to complete a paper identifying and responding to the messages in the book and how they pertain to your situation.

Deadline: Reflection Paper – Deadlines
You are required to write an essay explaining why your sanctions were not complete by the original due date. In addition, please address the importance of meeting deadlines. In addition, please respond to the following questions:

Door: Reflection Paper – Propping Doors
You are required to write a reflection paper that addresses the potential impact that the propping of doors can have on the community. This paper should address the following questions:

  • What responsibilities do you have to the safety of the residence in the halls.
  • How can you instruct your guests as to the policies of the residence halls and what can you do to help ensure that these policies are being adhered to?

You must read the book, Ethics and the College Student. You will then need to complete a reflection paper identifying and responding to the messages in the book and how they pertain to your situation.

You are required to write a reflection paper that addresses the following questions/statements:

Facbook: Focus on Alcohol Concerns, Book Report
You are required to read the book, Beer, Booze, and Books, by Jim Matthews (Viaticum Press, Peterborough, NH 1995), which you can obtain from the reserve desk at Norlin Library, or it can be purchased online. The “course” is Housing and the “professor” is Judicial Affairs. The book may be checked out for 72 hours at a time, and you are responsible for any fines accrued. You must write a paper on what you learned about how alcohol can affect your life as a student.

False: Reflection Paper – False Information
You are required to write a paper that addresses the following questions or statements:

  • What are the implications for a community when its members decide to lie to one another?
  • Explain why you chose to lie to staff members.
  • If students will not tell the truth to student staff, should we replace student staff with the police?
  • Explain the difference between your rights and your responsibilities in regards to community policies.

Read the policy section of the Guide to Residence Hall Living, and in a paper please give a brief summary of and rationale for the policies, paying special attention to the fire safety policy. You must find the statute, explain the rationale behind it, and the consequences for violating this law. You must also address the importance of safety in regards to carrying identification and why it is important to your community that its members and their guests carry identification. In addition, please respond to the following questions:

Tough: Making Tough Choices
You must read the book, How Good People Make Tough Choices. You will then need to complete a 5-page paper identifying and responding to the messages in the book and how they pertain to your situation.

Univpap: Reflection Paper - University of Colorado
You are required to write a reflection paper that addresses the following questions/statements:

  • Why are you a University of Colorado – Boulder student? What is your purpose for being here?
  • Why do you feel the Office of Admissions, on behalf of the university, selected you as a student?
  • How do your actions, for which you were documented, have a negative impact on your floor community?
  • Explain your responsibility as a community member living on your floor and what you will do in the future to make sure you are meeting the responsibilities and expectations granted to you upon your admission to the institution.
  • How do questions/statements 1-4 impact your future goals and aspirations as a student in the residence halls and university?
  • What are some of the potential consequences of your actions?
  • What is your understanding of why this policy was instituted?

Weapons: Reflection Paper - Weapons on Campus
You are required to write a reflection paper that addresses the following questions/statements:

  • Describe the situation for which you were documented, including how and when you obtained the air soft guns and what you chose to do with them.
  • Describe what happened when you were confronted by the resident advisors and the police.
  • How can the possession and/or use of air soft guns on campus impact others physically or emotionally?
  • Why this was a potentially dangerous situation?
  • What laws or rules regulate weapons on college campuses? Why are those rules in place?
  • What are some of the potential consequences of your actions?
  • What is your understanding of why this policy was instituted?
  • How were your personal values a factor in your decision making in this situation?
  • Are you registered to Vote? Do you volunteer in the community? Why is this relevant?

Apology
You will write a letter of apology to the named parties on your decision form regarding your comments and/or behavior during the incident. You will need to explain why your behavior was inappropriate as a maturing community member. This letter should be typed and submitted to the Office of Judicial Affairs no later than the date indicated on your decision form.

It is important for you to know that your conduct officer reserves the right to increase your current sanction and/or require you to re-submit the letter if there are mistakes, inappropriate language or messages. Being aware of this, it is in your best interest to turn the letter in early, in case any revisions are necessary. If you have any questions, please contact your conduct officer.

Party Plan
You are required to create a party plan with your housemates. This plan should set guidelines for your house when choosing to host a party. Examples include defining how many guests are allowed in the house, rules surrounding alcohol, and notification of neighbors and other housemates. The plan must be signed by all of your housemates. This plan is due no later than the date indicated on your decision form.

Anger Management
You are required to complete an anger management class. By the date indicated on your decision form, you must provide proof that you have successfully completed or are currently in attendance at an anger management class. This proof must be on the letterhead of the program providing the class and must bear the original signature of the presenter. It is your responsibility to set up and complete the class. You are also associated with any costs associated with this class. Resources for this class include Ken Autaubo at 303-908-7084 and Francis Kaklauskas at 303-545-9393.

Court Compliance
You are required to submit proof that you have completed all court ordered sanctions. Please submit this information by the date found on your decision form.

Before the conclusion of this semester attend [# found on your decision form] campus activities on a Thursday, Friday, or Saturday night and reflect on how you can connect to others socially in a manner that does not involve alcohol or other drugs. At the conclusion of your experiences write a response paper summarizing insights and learning gained. Please provide five suggestions that on-campus students could do to meet their needs for entertainment, socialization and stress release that does not involve alcohol and or drugs.

Community Restitution – Fire Safety
You are required to think creatively about how to get the message out to the residents of the residence halls that candles, incense and open flames are not tolerated. One violation may result in termination of your housing contract. This must be accomplished by poster, skit, video or whatever you decide. Proof of completion must be submitted to the Office of Judicial Affairs by the date indicated on your decision form.

Contact—No Contact Order
You, or third parties acting upon your behalf, are instructed not to contact or approach the named parties determined by your conduct officer.

Decision Making Workshop
You are required to attend the Young Adult Decision-Making workshop by the date found in your decision form. The Decision-Making Workshop is designed to enhance the decision-making skills of young-adults (ages 18-28) in Boulder County. The workshop is a one-time commitment scheduled multiple times each month. It is fully comprised of hands-on activities based in restorative values and proactive approaches. This workshop enables and initiates the prep work needed for effective decision-making. The workshop curriculum, written from a young adult perspective, combines activities of self-evaluation and the application of concepts to participant’s own life, with scenarios based in realistic and true examples. Workbook and other materials are provided. The cost of the workshop is $30, and you are responsible for any and all costs associated with attendance. Dream: Community Restitution - I Have a Dream Foundation
You must complete the number of hours required by your conduct officer of community service with the “I Have a Dream” Foundation of Boulder County. The Foundation serves low income youth in Boulder County through academic tutoring and mentoring support programs that are designed to help students graduate from high school. You must contact Catherine Barnes, the office manager, at 303-444-3636, to schedule a time to complete your hours. You will be helping with administrative tasks (i.e., filing, stuffing envelopes, etc.) at the central office in Boulder. You must submit to the Office of Judicial Affairs correspondence indicating that you have satisfactorily completed your service by the date on your decision form. This correspondence must be on the organization’s letterhead and must bear the original signature of the person supervising your service.

Fire
You are required to make posters about fire safety issues and why they are so important in the residence halls. You are to research a fire at another university (with pictures), gather information about burn victims, and make a large display with all the information you obtain. These are due to the Office of Judicial Affairs no later than the date indicated on your decision letter. After I have examined them you will post them in your hall.

Fire Department — Community Restitution
You are required to complete the number of community service hours, as assigned by your conduct officer, with the Boulder Fire Department. Please contact Sherry Kenyon at 303-441-4355 to set up your sanction. You must submit to the Office of Judicial Affairs correspondence indicating that you have satisfactorily completed your service by the date specified on your decision form. This correspondence must be on the organization’s letterhead and must bear the original signature of the person supervising your service.

Food Share — Community Restitution
You must complete the number of hours assigned by your conduct officer of community service with Community Food Share. By the date indicated on your decision form, you must submit to the Office of Judicial Affairs correspondence indicating that you have satisfactorily completed your service. This correspondence must be on Community Food Share letterhead and must bear the original signature of the person supervising your service. Please be aware that the Food Share is located in Niwot, but may be reached by the RTD. It is your responsibility to contact Sue Ericson, their Volunteer Coordinator, at (303) 652-3663, to set up your service.

Hill Clean-up
You must submit to the Office of Judicial Affairs correspondence indicating that you have satisfactorily completed a Hill Clean-up. This correspondence must be on organization letterhead and must bear the original signature of the person supervising your service. It is your responsibility to set this up. Please contact Gregg DeBoever via email at deboev@msn.com for more information about the hill clean-ups. You must complete the hill clean-up by the date on your decision form.

Intimate Partner/Domestic Partner Violence Treatment
You are required to complete a domestic violence treatment program. You are required to complete an evaluation process and then any recommended treatment from a licensed provider. Verification of both the evaluation and the treatment is due by the date indicated on your decision form.

Interview with Law Enforcement Personnel Regarding Marijuana
You are required to interview (either by phone or in person) a University of Colorado Police Department officer, using the questions provided below. You must ask all the questions listed, but feel free to ask any additional questions you may have. After completion of the interview, you must submit to the Office of Judicial Affairs a report documenting the conversation that is formatted for use as part of a residence hall newsletter. The purpose of the article is to educate residents about the legal consequences of marijuana use.

  • What is your name? Tell me about your background in law enforcement. Tell me about what you do now.
  • Tell me about your experience with people who use marijuana and other drugs. What is the worst case you have seen?
  • What are the typical consequences for a first time offender caught with marijuana by the police? Arrest? Jail? Fines? Court appearances? Anything else? How does the amount confiscated affect the typical consequences?
  • What are typical consequences for a second or repeat offender who is ticketed for marijuana possession and/or use? Again, tell me about how the amount confiscated affects the case.
  • How do you, as a law enforcement agent, view the relationship of marijuana use to the academic environment? Do you believe that a person can choose to use marijuana and still perform well academically?
  • What advice would you give to someone who is contemplating recreational drug use?
  • Is it true, in your experience, that marijuana is a gateway drug? Do you feel that society and the media reflect this characteristic of the drug accurately?

It is your responsibility to arrange the interview and complete the paper in time; therefore, it is in your best interest to begin immediately to avoid any problems with scheduling the interview or in case revisions are necessary. This paper is due to no later than the date on your decision form. It is important for you to know that your conduct officer reserves the right to increase your current sanction and/or require you to re-submit the paper if there are mistakes, inappropriate language or messages. Being aware of this, it is in your best interest to turn the paper in early, in case any revisions are necessary. If you have any questions, please contact your conduct officer.

Interview with Medical Personnel Regarding Marijuana
You are required to interview (either by phone or in person) a Boulder Community Hospital or Boulder County Fire Department official, using the questions provided below. You must cover all the material listed below, but you may ask any additional questions you may have. After completion of the interview, you must submit a report documenting the conversation that is formatted for use as part of a residence hall newsletter. The purpose of the article is to educate residents about the legal consequences of marijuana use.

  • What is your name? Tell me about your background in medicine. Tell me about what you do now.
  • Tell me about your experience with patients who use marijuana and other drugs. What typical symptoms do you generally see? What is the worst case you have seen?
  • What effect(s) does marijuana have on the individual physically, emotionally, and psychologically? On basic motor skills? Cognitive ability? Inhibitions? Energy level?
  • How do you, as a medical professional, view the relationship of marijuana use to the academic environment? Do you believe that a person can choose to use marijuana and still perform well academically?
  • What are some typical signs to show that a person has a problem with drugs, such as marijuana?
  • What advice would you give to someone who is contemplating recreational drug use?
  • Is it true, in your experience, that marijuana is a gateway drug? Do you feel that society and the media reflect this characteristic of the drug accurately?

Meeting
You are required to meet regularly with the party/parties assigned by your conduct officer until the date indicated on your decision form. It is your responsibility to set up these appointments in advance.

Personal Success Plan
You are required to create a personal success plan detailing how you plan to resist the temptations of alcohol and/or drugs while at the University of Colorado. This plan should include alternative activities in which you may participate, a list of friends and/or family members with whom you can spend time in a sober state, campus resources you might utilize, and any other elements that may contribute to your success as a student and as a sober person. This is due no later than the date indicated on your decision form.

Presentation: Alcohol Presentation
You are required to complete the number of presentations, as required by your conduct officer, to the University of Colorado at Boulder student body surrounding the topic of alcohol abuse or alcohol awareness. These presentations must be completed by the date indicated on your decision form. Your presentation should include information about the effects of alcohol, dangers of excessive alcohol consumption, how to assist individuals who are incapacitated due to excessive alcohol consumption. Evidence of completion of this sanction will include when and where the presentation was conducted, to whom the presentation was given, how many students attended and the method of marketing the presentation to the campus community. Additionally, a contact name and phone number will be required for verification purposes.

Recycling Services—Community Restitution
You must complete the number of community service hours, as assigned by your hearing officer, with Recycling Services on the University of Colorado’s Boulder campus. By the date on your decision form, you must submit to me correspondence indicating that you have satisfactorily completed your service. This correspondence must be on Recycling Services letterhead and must bear the original signature of the person supervising your service. It is your responsibility to contact Dana Kelly, their Volunteer Coordinator, at 2-8307, to set up your service.

Relocation—Judicial Relocation
You are being moved to a new residence hall room as specified on your decision form. You must be checked out of your current room by the date indicated on your decision form. Contact the hall director in your new building, as specified by your hearing officer, for the instructions concerning this move.

Sex Offender: Sex Assessment, Treatment and Evaluation
You are required to undergo treatment and evaluation from a licensed sex offender provider and follow any recommendation(s) that emerge from assessment. You may contact the following providers or obtain approval from the Director of Judicial Affairs to use another provider.
